Terms of Sales

When an activity is canceled for bad weather or COVID,  you have the choice of postponing it to a later date or being fully refunded. If you choose to refund, it will be made to the credit card you used when paying. This amount will appear on your account within 1 week maximum, unless you have a deferred debit card.

Until further notice, in the event of force majeure linked to COVID-19*, our association will provide any reimbursement and will not apply any cancellation fees for any online reservation, without proof.

* (impossibility of travel, new government measures, prefectural decree...)

A confirmed order cannot be canceled (in order to respect the guide who undertakes to supervise this outing) except on medical advice to the contrary. Only the association and its guides will be able to cancel the reserved services (case of force majeure, weather, etc.). Please consult our general conditions of sale below.

If the weather conditions do not allow the activity to be carried out, theassociationconfer and take the decision to cancel the outing. You will then have the choice between postponing your outing to a later date and being reimbursed.

It is only theassociationwho decide to cancel the outing if we believe that the conditions may alter the quality of the service. (Cool temperatures, cloudy skies or even a few drops of rain are not valid arguments).

    • To change the date: It depends on the status of your reservation. If your request has not yet been confirmed,  contact us.

    • To change the number of people: contact us, we will do our best to respond favorably to your request. Accordingour general conditions of sale below, the customer must inform the association at least 7 days before the date of the service.

These reservation and sales conditions govern the relationship between the Newsport BNN association and its customers, beneficiaries of services (reservation of rental and sports activities).
The confirmation of a reservation implies the acceptance of the general conditions of reservations and sales as set out below.

Article 1 - BOOKING CONDITIONS


The rates for the services offered by Newsport BNN are applicable to all.
The reservation of a service necessarily implies the acceptance of these conditions.

They are communicated at the latest when booking the service.
Any service reservation becomes effective upon receipt of payment (Art.3).
A service is considered definitively confirmed only upon payment of the service or
the payment of the deposit with, if necessary, the reservation proposal signed and bearing the mention "good
for approval ".
Participants and group leaders declare that they are informed of the rights and obligations of
each part.

Article 2 - GUARANTEES

The Newsport BNN association has professional civil liability insurance as well as a financial guarantee, the amount of which has been set by the public authorities.

In the event of cancellation by Newsport BNN, of one or all of the services in a case of force
major, the full refund of the sums paid is guaranteed.

​

In the event of cancellation for bad weather conditions, by unilateral decision of the NewSport BNN association 12 hours before the service, certain outdoor activity services may be reimbursed. 

 

Article 3 - PRICES


The prices are denominated in euros and calculated excluding taxes. They are not increased by the VAT rate, the associative status  implying a VAT exemption, according to article 293 B of the CGI. 
In the case of fixed prices, the prices apply globally to the reserved services.
The rates confirmed on the agreement in principle are firm for 15 days from the date of dispatch and subject to modification without notice in the event of non-confirmation of the estimate.

Article 4- PAYMENT CONDITIONS


Invoices are drawn up in euros and must be paid in euros. Newsport BNN does not support
no exchange fees or transfer fees.

 

INDIVIDUAL RESERVATIONS

Reservations for individuals are made by paying the full amount either via our website or directly on our premises by credit card, holiday vouchers or cash.

 

 

GROUP RESERVATIONS
Only receipt of payment by cheque, bank card or cash definitively validates the
reservation of a service within our services. Any validation of reservation will be taken into
account upon receipt of a 30% deposit, and the balance of the total amount must be returned after
invoice issued on the day of the service, by check payable to Newsport, bank transfer or payment in
species. Newsport BNN reserves the right to cancel any reservation in the event of non-payment
according to the schedule set out in our special conditions below.
The balance invoice to be paid within 30 days will be sent to you at the end of your activity,
taking into account your payments, any changes made after signing the
contract and extras not paid on site by the participants. In the context of exceeding the
deadline for payment of the final invoice, Newsport BNN reserves the right to charge the interest of
delay at the rate of 1.5% per month.

 

Article 5 - COMPLAINTS


Any complaint must reach us by registered letter with acknowledgment of receipt within
30 days after the end of the service at the head office of Newsport BNN.

 

Article 6-1 - SPECIAL CONDITIONS: INDIVIDUAL

A – INDIVIDUAL RESERVATION

Our particular activities are reserved on our website or on site depending on our availability.

Article 6-2 - SPECIAL CONDITIONS: GROUP


A – GROUP RESERVATION
The reservation is made with our services and is subject to a reservation confirmation. She
becomes effective upon receipt of the booking confirmation with signed quote and the
mention "good for agreement", accompanied by a deposit of 30% of the total amount of the service.
In the absence of the return of this document, the reception of the deposit implies the total adhesion of the customer
to these general conditions.


B – PRICES 
Our rates are applied to all participants, in the form of a package or an individual rate depending on the activity chosen.


C – MODIFICATION OF THE NUMBER OF PARTICIPANTS
The Customer must inform the association at least 7 days before the date of the event of any
modification of the number of Participants in the event. The reduction in the number of Participants
is considered as a partial cancellation of the reservation giving rise to the application of
Section F2 hereof. If the number of Participants turns out to be greater than the number indicated on the contract, the
availability of activities will only be confirmed subject to availability and
after receipt of the additional deposit corresponding to the reservation differential. In case of
non-availability, the contract is deemed to continue according to the terms and conditions determined in the
contract/quote.


D – MODIFICATION OF BENEFITS
Any request for modification of the services in relation to the accepted contract/quote must be
addressed in writing to the association and will be duly invoiced by the association. The association may, at any time and
without any reason, refuse the request for modification of benefits. In the absence of written acceptance of
establishment within 8 days of receipt of the request, the contract is deemed to continue according to
the terms and conditions determined in the contract accepted by the Client. In this case, the agency
cannot be sought in payment of any compensation.

E - NO-SHOWS
In the event of "no-shows" (cancellation without notice), the association will invoice the Client for compensation equal to
100% of the amount including VAT of the services on all activities. The Customer undertakes to pay the
sums due in the event of a no-show under the conditions defined in the contract.

F-1 - INDIVIDUAL CANCELLATION

1- Cancellation by the customer
In the event of the cancellation of a reservation within 72 hours, the customer cannot claim any refund.

2- Interruption during the service
In the event of an interruption during the service, the customer cannot claim any refund.

3- Cancellation by NewSport BNN
NewSport BNN reserves the right to cancel, postpone or adapt the activity depending on the weather conditions or the level of the participants.

The activity can be canceled for security reasons or for any other case of force majeure. In this case the service is fully reimbursed, if and only if it has not generated costs and without being able to claim any other compensation. 

4 – Disqualification
NewSport BNN reserves the right to exclude a client who is inebriated or whose behavior is likely to disturb the smooth running of the activity or compromise the safety of the group. In the event of exclusion, the customer cannot claim any refund or compensation.

F-2 - GROUP CANCELLATION (more than 10 people and according to article 5 A)

Billing being made on the basis of services, the Customer is invited to pay the greatest attention to the cancellation conditions below. Cancellations of all or part of the initial booking must be made in writing to NewSport BNN.
In case of interruption for any reason whatsoever, the full price  pour
all of the agreed activities will be collected without possible recourse from the Customer. Is also
considered as a cancellation of the activity any activity started but which would be interrupted, whatever
whatever the reason for the interruption. Is also considered as a total cancellation or
late partial any cancellation received by the association beyond the deadlines provided for herein.


1/ Total cancellation: are considered as a total cancellation and giving rise to the application
the cancellation conditions defined below:
- The change of date of the activity.
- In the event of non-compliance with payment deadlines, the association shall have the option of requiring the Customer to
immediate payment of the balance of the activity, the payment of the Customer having to reach the association
within 8 days from the date of the association's written request. In the absence of
payment within this period, the event will be considered as definitively canceled at the fault
exclusive to the Customer.


In the event of total cancellation, as compensation, the association will retain the deposit(s) paid or
will invoice the Customer as indicated below:

- more than 30 days before the first day of the date of the activity: no fees will be charged and a refund will be made.
- more than 15 days before the first day of the date of the activity: the amount of the
installments provided for in the special conditions.
- 15 days or less before the first day of the date of the activity: 100% of the amount  des
reserved services.


2/ Partial cancellation: A partial cancellation corresponds to a reduction in the amount of the contract
whatever the cause: reduction in the duration of the event, the number of people
and/or services ordered.


In the event of partial cancellation, the cancellation costs incurred by the customer are as follows:
- Up to 30 days before the first day of the event, no charge in the event of partial cancellation,
- Between 29 and 7 days before the first day of the event, cancellation free of charge up to 20% of the
total amount of the event, for any cancellation greater than or equal to 80% of the amounts
canceled will be charged
- Less than 7 days from the start of the event, 100% of the canceled amounts will be invoiced.


G – CASE OF FORCE MAJEURE
In case of weather not suitable for the practice of outdoor activities: rain, wind, risk of fire...alone
the Newsport BNN association and its guides will be able to cancel the reserved services. Newsport BNN
notify the customer by email or other means at his convenience of the cancellation of the service and
will refund all amounts paid.

For any reservation for the year 2021, in the exceptional context of COVID-19, our association will not apply any cancellation fees and will ensure any reimbursement in the event of force majeure linked to COVID-19 (impossibility of travel, new government measures , prefectural decree, etc.).


H – PRIOR FORMALITIES AND INSURANCE
The customer is responsible for any declaration or request for authorization from the
organizations and/or administrations. Under no circumstances will Newsport BNN be held responsible for the defect
of these statements.
The client must inform Newsport BNN of any medical contraindications to the practice of
sports activity (respiratory problems, heart problems, etc.).
Newsport BNN has professional civil liability insurance (resale of activities
sports) taken out with Maif, moreover all the supervising service providers are subject to professional civil liability.
Newsport BNN cannot be held responsible for any incident occurring outside
of its provision of tourist and sporting activities.
In the event of exposure of materials or valuables, we recommend that the customer take out,
costs, damage and theft insurance.
